If you’re planning to propose on the beach near West Palm Beach, there’s something worth understanding before you start dreaming up an elaborate setup: across South Florida, permit rules for beach and park events have tightened in the last couple of years, and they’re being enforced. The goal is to keep beaches open and safe for everyone — but it does change how bigger proposal setups are handled.
At The Love Pics, I’ve photographed over 200 proposals and love stories across South Florida in the last 15 years, and I want your moment to feel magical, not stressful. So let me break it down in simple terms.
First, know which “beach” you’re actually on
This trips up almost everyone. A lot of proposals people call “West Palm Beach” actually happen on oceanfront that’s controlled by a different municipality — the Town of Palm Beach across the water, Lake Worth Beach to the south, or a Palm Beach County park. West Palm Beach’s own waterfront runs along Flagler Drive and the Intracoastal. Each city, town, and county park sets its own rules, so what’s required depends entirely on the exact spot you choose.
What can require a permit
As a rule of thumb, an intimate proposal between the two of you is fine. What can cross into “special event” territory — and require a permit — is a setup that takes over public space or brings a crowd: large arches, marquee letters, lighting or sound structures, generators, or a group of guests gathered to watch.
Depending on the beach, a permitted setup can mean applying in advance, carrying liability insurance, and following time limits for setup and cleanup. Some places also restrict items like banners, balloons, and flags. And yes — code enforcement or police can shut down a setup that doesn’t have the right paperwork.
How to propose without needing a permit
The good news: intimate proposals can still happen with no paperwork at all. Enforcement is aimed at setups that block public access or take over a large area. A small footprint that you can set up and clear quickly usually stays well out of “special event” territory. Think a soft blanket, delicate flower petals, LED candles, and the two of you. It’s romantic, it’s photogenic, and it keeps the focus where it belongs: on your story.
What to avoid if you want to keep it simple and paperwork-free: large arches, marquee letters, generators, sound systems, and big guest setups. They’re beautiful — but they’re exactly what signals “event” to code enforcement.
One important note: rules vary by location and change over time. Always confirm current requirements with the specific city, town, or county that manages your beach — or simply have me handle it. If a permit is required for your chosen setup or location, obtaining it is the client’s responsibility — or, if you’d rather not deal with it, I can take care of the permit application for you for an added $200.
